Napagalaman na dahilan kung kayat naitayo ang Lucky South 99 na siyang nagpapatakbo ng Philippine Offshore Gaming Online (POGO) sa Porac, Pampanga ay dahil sa kontrobersyal na “Letter of No Objection”na nilagdaan ng noon ay mga kasapi ng Sangguniang Bayan ng nasabanggit na lokal na pamahalaan taong 2019.
Kabilang sa mga sumang-ayon o pumirma sa aplikasyon ni Cassandra Ong para sa LONO ng Lucky South 99 sa ilalim ng Municipal Resolution No. 119 ay sina former Porac Councilor Mike Tapang na ngayon ay tatakbo bilang alkalde kasama sina former vice mayor Charlie O. Santos, at dati ring mga konsehal na sina Maynard T. Lapid, Francis Laurence Tamayo, Roman Paul C. David, Remberto M. Lapid, Rito S. Buan, Michelle C. Bengco, Princess L. Buan, Edwin L. Abuque, and Jin Mikhaela M. Canlas.
Si Municipal Liga ng Barangay President Maximo E. Bungque ay absent nang isagawa ang Regular Session No. 16 nang pirmahan ang LONO noong November 5, 2019 sa Fortune Sea Foods Restaurant Function Room sa Clark Freeport Zone.
Ang mga nabanggit na opisyales ay lumagda sa nasabing controversial “Letter of No Objection” ang siyang nagbigay daan upang maipatayo ang Lucky South 99 sa Pulung Maba, Porac, Pampanga taong 2019.
Sina Tapang at Santos ay kapwa tatkbo ngayong 2025 elections bilang mga alkalde ng Porac.
Ang mga nabanggit na dating mga lokal naopsiyal ng Porac ay kabilang sa reklamong isinampa ni DILG Undersecretary Juan Victor R. Llamas sa Ombudsman kasama na ang mga new elected councilors sa taong 2022 na ngayon ay pinatawan ng six-month preventive suspension noong Oktubre 7.
Kabilang dito sina Councilors Rafael M. Canlapan, Adrian R. Carreon, Essel Joy C. David, Hilario D. Dimalanta, Michelle B. Santos, John Nuevy L. Venzon, Rohner L. Buan, at si Regin B. Clarete na namatay na noong May 2023.
Suspendido rin sina Porac Mayor Jing Capil at Vice Mayor Tamayo, Emerald Vital, Licensing Assistant at former OIC-Business Permit and Licensing Office.
Ang kasong isinampa sa Ombudsman laban sa 21 respondents na may case docketed as OMB-C-A-SEP-24-0093 ay “Gross Neglect of Duty.”
Pumirma si suspended Porac Mayor Capil sa LONO noong November 2019 na maaaring inilarawan bilang ministerial.
Ang Municipal Resolution 119 Series of 2019, ay “resolution interposing no objection to the application of Ms. Katherine Cassandra L. Ong, for the franchise/license/permit application of the Lucky South 99 Outsourcing Incorporated, to national and local government agencies, offices, and bureaus, for the company’s intention to establish, operate and manage Business Process Outsourcing Services and activities at its office in Porac, Pampanga”.
Sinasabi rin sa Porac Municipal Resolution na: “the Lucky South 99 Outsourcing Inc. pursuant to the company’s Articles of Incorporation, shall engage in the export of services by the way of business process outsourcing, serving as an independent contractor performing and offering front and back office services including but not limited to the establishment of contract centers, handling information technology-based business functions and processes, inbound and outbound calling, sales facilitation, logistics, economic management, customers service, technical support and the provision of promotional, maintenance, training, communication, testing, market research, web design and development, content writing and other administrative services outsourced buy foreign business entities, particularly but not exclusively to those in the casino and hotel resort industry without being engaged as an Internet Service Provider.”
“As a prelude to their (Lucky South 99) applications to various government offices, for franchise, license and other permits, is requesting for a Sanggunian’s Resolution of No Objection,” ayon pa sa Municipal Resolution.
Ang LONO ay siyang ginamit naman ng Lucky South 99 para sa permit application nito sa Philippine Amusement and Gaming Corporation (PAGCOR) noong 2019.
Ang pertinent permits ng Lucky South 99 ang siya naman ginamit nito sa pag-aapply nsa Porac Municipal Hall upang makakuha ng business permit.
Sa isang special session ng Sangguniang Bayan ng Porac, nabatid buhat nang mag-operate ang Lucky South 99 ay tumatanggap ang PAGCOR ng $150,000 buwan-buwan ayon kay Atty. Joseph Lobo, isang PAGCOR lawyer.
Napag-alaman pa na tanging ang PAGCOR lamang na o sole government agency ang authorized para kumolekta ng taxes mula sa POGO operators sa bansa sa ilalim ng RA No. 11590 or an “Act Taxing Philippine Offshore Gaming Operations”.
Nabatid pa na ang tanging fees collected ng Porac LGU mula sa Whirlwind Corporation are bayad sa Building Permit, Electrical Permit, Locational Clearance, Certificate of Occupancy, and Surcharge.
Ang Porac LGU ay hindi na nagbigay ng business permit sa Lucky South 99 nitong taong 2024.
